米国際貿易委員会（International Trade Commission：ITC）は，2008年12月15日，フラッシュ・メモリに関する特許侵害の疑いで，韓国Samsung Electronics Co. Ltd.やソニー，米Apple Inc.など33社への調査を開始すると発表した（発表資料）。調査対象となるのは，USBメモリやデジタル・カメラ，電話機，音楽プレーヤー，パソコンなどに使われているフラッシュ・メモリ・チップである。
この調査は，米Spansion, Inc.および米Spansion LLCが2008年11月17日に，ITCに提訴した申し立てに基づくもの（Tech-On!の関連記事）。両社は，「Spansion社の保有する特許を侵害するフラッシュ・メモリとそのフラッシュ・メモリを搭載する製品が米国に輸入・販売されており，これが米関税法337条に違反する」と主張している。両社はITCに対し，これらの製品の米国市場から排除や，輸入・販売を停止する命令を発行するよう求めている。
ITCは，調査開始から45日以内に調査完了の目標期日を決定する。ITCの処置命令は，米通商代表部に却下されない限り，発令から60日目に最終決定となる。
